CANCELLATION OF SHOW

• EIFS Management may cancel or postpone the Show on any or all of the Show open days owing to a force majeure event (including floods, earthquakes and other acts of God) or inclement weather conditions (which means weather conditions that are unacceptable to EIFS Management in that such conditions would impair exhibits, cause damage to equipment, or raise health and safety concerns.

REFUNDS

• No deposit refunds will be made to Retail Gardens who fail to exhibit.

INSURANCE

• EIFS Management and Christchurch City Council carries third party insurance cover in respect of any such claim through its liability or negligence during the Show.

EXHIBITOR INSURANCE

• Insurance cover for loss or damage to Exhibitors’ goods or property on site is the full responsibility of the Exhibitor.  Exhibitors are encouraged to obtain insurance cover for their property.

• Exhibitors are strongly urged to take out insurance to cover the possibility that the Show may be cancelled by EIFS Management due to a force majeure event or inclement weather conditions.

LIABILITY

EIFS Management
 

• EIFS Management will not be liable for compensation for loss or damage by theft, fire, water, accident, the requirements of the local authority, or any other cause whatsoever.

• EIFS Management has no responsibility to any but its own employees and members of the public.

Exhibitor 

• All exhibits will be staged, and all personal property will be placed, at the risk of the Exhibitors.  Although EIFS Management arranges 24 hour professional security cover of the Show site, Exhibitors are solely responsible for the security of their property before, during and after the Show.  EIFS Management will not be liable for any loss or damage whatsoever caused.

• If the Show is cancelled on any or all of the Show open dates, for any reason due to a force majeure event or inclement weather conditions.  Exhibitors shall not have a claim on EIFS Management or its employees for loss, damage, interest, or compensation. 

CONFIDENTIALITY
Any agreement reached between the Exhibitor and EIFS is to be treated as confidential between the parties.

GENERAL

The Council, in terms of its regulatory function as a local authority, is obliged to and shall act as an independent local authority and not as the owner and operator of EIFS.  The Exhibitor shall have no right or claim against the Council in its capacity as the owner and operator of EIFS as a result of any lawful action or decision made by the Council in the performance of its regulatory function except in the case of bad faith in its capacity as owner and operator of EIFS.

INDEMNITY

• The Exhibitor shall indemnify EIFS Management in respect of all costs (including legal costs), claims, liabilities, losses, damage and expenses suffered or incurred by EIFS Management and any other person claiming through EIFS Management as a direct or indirect consequence of any unlawful, negligent, tortuous, criminal, reckless or dishonest errors, acts of omissions of the Exhibitor in the performance of its obligations under this Guide and the Exhibitor Information Booklet.

• The Exhibitor warrants that it has the authority, copyrights, permissions or licences that may be required for their exhibition and shall indemnify and keep indemnified EIFS Management from and against all claims, liabilities, losses, damage and expenses suffered or incurred by EIFS Management in connection with any breach of the Exhibitor
of the these warranties.
